1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and GhostSMS LLC, a Wyoming limited liability company ("GhostSMS", "we", "us"), the operator of this website and its related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of the Service

The Service provides users with the ability to rent temporary, non-permanent phone numbers for the purpose of receiving SMS messages ("Temporary Numbers"). The Service is provided on a pre-paid basis through a system of credits ("Credits").

Temporary Numbers are not permanently assigned to you. Once your rental or activation period ends, a Temporary Number may be recycled and reassigned to other users. GhostSMS makes no representation that you will be able to access or use the same Temporary Number again in the future, including for purposes of re-verifying or recovering an account previously registered on a third-party service using that number.

3. User Accounts

• Account Creation: To access the Service, you must create an account by providing a valid email address, your name, and a password. You are responsible for maintaining the confidentiality of your account and password.
• Account Responsibility: You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
• Account Termination: We reserve the right to suspend or terminate your account at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties.

4. Payments, Credits, and Refunds

• Credits: The Service is operated on a Credit-based system. To use the Service, you must purchase Credits.
• Payments: All payments are processed through our third-party payment processor (Stripe). We do not store or have access to your full credit card information.
• Pricing: The price of Credits and the cost of renting Temporary Numbers are subject to change at any time without notice.
• Refunds: Except as required by law, all purchased Credits are non-refundable. We may, at our sole discretion, offer refunds in specific circumstances, such as for a malfunctioning Temporary Number.

5. Prohibited Uses

You agree not to use the Service for any of the following purposes:

• Illegal Activities: Engaging in any activity that is illegal under local, state, national, or international law.
• Harassment and Abuse: Sending or receiving harassing, abusive, or threatening messages.
• Spam: Sending unsolicited messages (spam).
• Fraud: Impersonating any person or entity, or engaging in any fraudulent activity.
• Bypassing Verification Systems: Using the Service to bypass security or verification systems of other services in a manner that violates their terms of service.
• Resale: Reselling or sub-licensing the Service or the Temporary Numbers.

Violation of these rules may result in immediate suspension or termination of your account without a refund.

6. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, that the Service will be uninterrupted, error-free, or secure. We do not guarantee the deliverability of all SMS messages to your Temporary Number.

Because Temporary Numbers are not permanently assigned and may be reassigned after your rental or activation period ends, we do not guarantee that any third-party account or service registered using a Temporary Number will remain accessible, verifiable, or recoverable at any later point. Third-party services may, at their sole discretion, restrict, suspend, flag, or terminate accounts registered using a Temporary Number, and may require re-verification at any time, including via the original phone number. You are solely responsible for reviewing and complying with the terms of service of any third-party platform you access using the Service. GhostSMS has no obligation or ability to provide continued or repeated access to a previously used Temporary Number, and disclaims all liability arising from any action taken by a third-party service against your account.

7. Limitation of Liability

To the fullest extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total aggregate liability to you for all claims arising out of or relating to the Service exceed the greater of (a) the total amount you paid us in the three (3) months immediately preceding the event giving rise to the claim, or (b) one hundred dollars ($100).

8. Indemnification

You agree to indemnify, defend, and hold harmless GhostSMS, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or contractual right; or (d) your violation of any applicable law or the terms of service of any third-party platform accessed using the Service.

9. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, governmental action, labor disputes, or the failure, outage, or unavailability of any third-party SMS provider, telecommunications carrier, payment processor, or hosting or infrastructure provider.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of such changes by posting the updated Terms on this website and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
